You’re about to embark on a journey of discovery, where you’ll learn new skills and challenge yourself every single day. Take a look at all the relevant details about my class and if you have any questions, please feel free to connect with me and get in touch. In the sections below, you will find a day by day break down of what each class will look like so that it is easy to follow along. Details about submission of work will also be included with each piece as there will be numerous ways that we will be running class and every class will not be exactly the same. Each class will state the requirement of that particular class, including assignments, work to be completed as well as PowerPoint slides to follow and most importantly, the specific times we will be live as a class, and the method in which this will be achieved (e.g. Zoom Live Video Conferencing)

Class Overview

In the information below, you will find what will be scheduled for each class moving forward. Not every class will run the same, however, you will be expected to do your part and complete as much as you can. Classes will contain aspects such as videos, live streaming Question and Answer, prerecorded videos to watch and much more. I want to try and make this as engaging for your learning as I can however, we all know this is uncharted territory for us all. If we all stick together and help each other with the learning process, the time of COVID-19 Coronavirus will be a distant memory and something that you talk about for years to come. Remember - it can only make you a stronger person :)

Please make sure that you go online and create the following accounts using your new gmail:

Kahoot - new account with your gmail. As I am using this mostly as a tool for assessment, please only write your real name so that the results can be logged. Any names that are not recognized are given a zero. The website is: www.Kahoot.it

Zoom - Please log on to www.zoom.us and create an account using your new gmail account. You will be notified in various ways ahead of time when you are expected to be online.

This tool is also going to be used for individual talks, questions and generally checking up to see how you are all doing. I will definitely miss being around you all!

When you have re-familiarized yourself with what has been covered in the chapter (through the summary you just read) please answer the following questions:

This will give you ample preparation for your upcoming Quest on the chapter. The Quest will be based around similar case studies.

CHAPTER 3 NOTES

Discrimination, stereotyping - equality. Is it possible to be equal? What barriers are faced - case studies. How to Analyze a human rights case (5 step) Prep for Quiz after Spring Break on unit.

DISCRIMINATION - what does it mean to you? How would you define it? Have you ever been discriminated against based on what your definition is?


Yours VS Actual definition - were you close? Would your answer from 1 change based on the actual definition? 


HUMAN RIGHTS - Rights protecting a person from unfair treatment by others

  • Not always upheld by justice system


  • Equality Rights: Section 15 of the charter - broken down into the following:

    • Race, National/Ethnic Origin, Colour, Religion, Sex, Age, Mental or Physical Disability - courts later adding citizenship, martial status and sexual orientation

      • E.g. Andrews Vs Law Society of BC - only citizens could practice in BC

    • Mass exclusion/little opportunity

      • working class women worked alongside husbands

      • Middle class restricted to mostly nursing and teaching

      • Led to suffragette movement  (1876 in Canada - Emily Stowe) - feminist wanting equality. 1912 WPG - Nellie McClung - Winnipeg Political Equality League leading to 1916 MB Women getting the vote

      • Dominion Elections Act (1920)


    • Not all women have vote - some still fighting for the right


  • 1955 legislation favouring hiring males abolished



Q. Why do you think that war has a lot to do with the changes in equality for women? Think of WW1 and WW2 - what examples might have helped bring about change?


Q. Were there any examples where even the world war could not bring about total change?

Has that changed today? 

Do you think the women would have been welcomed warmly into the military? What might they have faced?

Politicians VS courts - politicians make laws but courts have power to ‘interpret’

Q. What issues could potentially occur? 

 

A.   - Bias - putting personal viewpoint on law making AKA Judicial Activism

  • Govs. avoiding controversial issues forcing courts to protect BASIC rights

 

Do the Courts have too much power?

Using this information Read Pages 66/67 and answer the following questions:

2 ways to enforcing rights and Freedoms:

  1. Utilizing authority given under section 52 of Constitution Act

​

  •  The Constitution is the most powerful law in Canada, if other laws or parts of laws can be used to go against the constitution = unconstitutional. This provides 3 options:

​

  1. Strike Down - law no longer has any effect

  2. Read Down - allows for narrow interpretation of the law, usually considers what is in statute

  3. Read In - Changes the law but also allows law to be upheld as constitutional 

 

​

   2.  Seeking a remedy under section 24 of the CCoRaF

  • Rights infringed 

​

​

E.g. Right to a trial in reasonable time violated = thrown out of court if successful

E.g. House searched without warrant - court would have to decide if rights were infringed and ‘evidence’ taken unlawfully

We have a guest speaker on Thursday. Mr. Anthony Foderaro who is a practicing lawyer who specializes in civil law.

I would like you each to come up with 3 potential questions that you might ask about civil law - particular emphasis on litigation.

Submit them to the correct folder in the drive labelled "Questions for lawyer" - if you have not handed them in by Wednesday, you wont get a mark because you will be using them to quiz the lawyer. I have to vet them first to OK them first.

The rest of the week's work is going to consist of the following:

FAMILY LAW - You are going to need to read chapters 13, 16 and 17 in order to complete these tasks by the end of the week.

1.  Chapter 13 - Marriage. You will be having a final quest on Friday that relates to the issues of marriage and wills (chapter 16). You will find these all in chapter 13. Below you will find the terms that you will need to know as well as reading thoroughly (case studies included)

Using the information provided on the webpage, follow the instructions to make your imaginary Will and Testament! Imagine where you will be in 30 years time - what will your assets be? Will you have kids? Married? How will you divide your share?

Prepare a contract for whatever section you choose. Make sure you clearly demonstrate to the person reading the contract (Me, Mr. Jones), what the legal parameters are (what exactly is law binding, what is the contract about etc.)
